Does the IRS have constitutionally authority to view personal phone records for taxing purposes?
The IRS wants to tax company issued cell phone use. But they say you can avoid this tax liability by proving you were using “personal cellphones for nonbusiness calls during business hours.”
Which means in order to avoid paying taxes on personal cellphone use, you will have to PROVE to the IRS the difference between “personal” calls and “business” calls when at work.
Is that Constitutional??

The IRS has the constitutional authority to assess tax on the value of some fringe benefits including personal use of a company car and cell phones. If it audits your return, it would need to see documentation to show how much was business and how much was personal. Figure out the rest using logic.
